The Prevention of Money Laundering Act (PMLA) is an Indian law that aims to prevent money laundering and the financing of terrorist activities. As per recent developments, the Indian government is planning to bring crypto intermediaries under the ambit of #PMLA. This means that cryptocurrency exchanges, wallet providers, and other intermediaries will be required to comply with the PMLA regulations, including customer due diligence and reporting suspicious transactions.
The Indian government introduced a significant notification on March 7, 2023 bringing into coverage of various crypto intermediaries within the purview of the Prevention of Money Laundering Act, 2002 (PMLA). However, the Supreme Court of India overturned the ban in 2020, paving the way for greater adoption of #cryptocurrencies in the country.
The global cryptocurrency industry has been slammed by setbacks, scandals and high-profile failures in recent months, sparking a regulatory rush to protect consumers from fraud and scams. The global crypto market stands at more than $1 trillion and has risen sharply in recent months, although it remains far below its 2021 peak of $3 trillion. The number of crypto customers "grew during the Covid lockdowns .

The Indian government is in the process of framing a national law to regulate the cryptocurrency market. In a fresh statement the Reserve Bank of India said, the use of Private cryptocurrencies pose immediate risks to customer protection and anti-money laundering (AML) and combating the financing of terrorism (CFT), the Reserve Bank of India (RBI) and Financial Stability Report (FSR) noted. They are also prone to frauds and to extreme price volatility, given their highly speculative nature. Longer-term concerns relate to capital flow management, financial and macro-economic stability, monetary policy transmission and currency substitution," the report said.
According to the Financial Action Task Force (FATF), the virtual asset ecosystem has seen the rise of Anonymity-Enhanced Cryptocurrencies (AECs), mixers and tumblers, decentralised platforms and exchanges, privacy wallets, and other types of products and services that enable or allow for reduced transparency and increased obfuscation of financial flows. New illicit financing typologies continue to emerge, including the increasing use of virtual-to-virtual layering schemes that attempt to further muddy transactions in a comparatively easy, cheap and anonymous manner, the report said. These comments assume significance in the context of ongoing debates on whether India should ban private cryptocurrencies or not. The RBI, time and again, has highlighted the deeper macroeconomic concerns posed by the unregulated private cryptocurrency market in India. However, the central bank is open to the idea of introducing a Central Bank Digital Currency (CBDC).
The report reflects the collective assessment of the Sub-Committee of the Financial Stability and Development Council (FSDC) on risks to financial stability and the resilience of the financial system. The cryptocurrency market in India, presently, stands at $15 billion, and the volume and value will only increase in the future. Anticipating a dramatic rise in crypto investments in the country, stakeholders in the industry began voicing their support for a robust, accessible, and clear framework on the regulation of cryptocurrency in the country. The Cryptocurrency and Regulation of Official Digital Currency Bill, 2021, to be introduced in the Lok Sabha soon, aims to prohibit all private cryptocurrencies in India while seeking to create a facilitative framework for adopting a central bank digital currency (CBDC). The Bill is likely to classify mining, generating, holding, selling, or dealing in private digital currencies as a cognisable offense. Prime Minister Narendra Modi said that emerging technologies such as cryptocurrencies should be used to empower democracy, not undermine it. Reports suggest that the government may introduce stringent regulations in line with the 2021 Financial Action Task Force (FATF) guidance for cryptocurrencies held as assets by imposing investment ceilings, stringent disclosure norms, and levying taxes on gains earned from such assets. In less than 10 years, Bitcoin has increased over 227,000% in value. When it first launched, a 22-dollar investment would now be a million dollars today. In November 2021, the global cryptocurrency market, constituting more than 6,000 cryptocurrencies, touched a market capitalization of $3 trillion.
