ആധാർ ബന്ധിപ്പിക്കുന്നതിനുള്ള സമയപരിധി കേസ് പരിഗണിച്ച സുപ്രീംകോടതി അഞ്ചംഗ ഭരണഘടനാ ബെഞ്ച് 2018 മാർച്ച് 31 വരെ നീട്ടി നൽകി. ബാങ്ക് അക്കൗണ്ട്, സർക്കാർ ആനുകൂല്യങ്ങൾ, പാൻ കാർഡ്, മൊബൈൽ ഫോൺ കണക്ഷൻ തുടങ്ങിയവയ്ക്കാണ് കേന്ദ്രസർക്കാർ ആധാർ നമ്പർ നിർബന്ധമാക്കി ഉത്തരവിറക്കിയത്.
ആധാർ നമ്പറും പാൻ നമ്പറും ബാങ്ക് അക്കൗണ്ടുമായി ബന്ധിപ്പിക്കുന്നതിനുള്ള സമയപരിധി 2018 മാർച്ച് 31വരെ നീട്ടിയതായി കേന്ദ്ര ധനമന്ത്രാലയം കഴിഞ്ഞ ദിവസം അറിയിച്ചിരുന്നു.

ആധാര് പാന് കാര്ഡുമായി ബന്ധിപിക്കുനതിനുള്ള കാലാവധി കേന്ദ്ര സര്ക്കാര് അടുത്ത വര്ഷം മാര്ച്ച് വരെ നീട്ടി.അധാര് പാര്കാര്ടുമായി ബന്ധിപ്പിക്കുന്നതിനുള്ള അവസാന തിയതി ശനിയാഴ്ച്ച രാത്രി അവസാനിക്കവേ ആണ് സെന്ട്രല് ബോര്ഡ് ഓഫ് ഡയറക്ട് ടാക്സസ് സമയപരിധി നീട്ടി നല്കിയത്. ഇത് അഞ്ചാം തവണയാണ് കേന്ദ്ര സര്ക്കാര് ബന്ധിപ്പിക്കല് കാലാവധി നീട്ടി നല്കുന്നത്. നികുതി ദാതാക്കള് ആദായ നികുതി ഫയല് ചെയ്യുന്നതോടൊപ്പം അധാര് നമ്പര് കൂടി ചേര്ക്കണം എന്ന് കൂട്ടി ചേര്ത്ത് കഴിഞ്ഞ വര്ഷം കേന്ദ്രസര്ക്കാര് ആദായ നികുതി നിയമം ഭേദഗതി ചെയ്തിരുന്നു.എല്ലാവരും പാന് കാര്ഡ് എടുക്കണമെന്നും നിയമമുണ്ടാക്കി.പാന് കാര്ഡ് ഉള്ളവര് ഇത് ആധാരുമായി ബന്ധിപ്പിക്കണമെന്നും നിര്ദ്ദേശിച്ചു.അധാര് നിയമവുമായി ബന്ധപ്പെട്ട കേസുകള് സുപ്രീം കോടതിയുടെ പരിഗണനയിലാണ് . ഇക്കാരണത്താല് ആധാര് ബന്ധിപ്പിക്കലിനു പരിധി നിശ്ചയിക്കരുതെന്ന വാദത്തെ സുപ്രീം കോടതി പിന്താങ്ങിയിരുന്നു. മേയില് അധാര് കേസുകളില് വാദം അവസാനിച്ചെങ്കിലും വിധി പുറപ്പെടുവിച്ചിട്ടില്ല.

ആധാറുമായി ബന്ധപ്പെട്ട സുപ്രധാന ചോദ്യങ്ങള്ക്കാണ് സുപ്രീം കോടതി വിധിയോടെ ഉത്തരമായത്
ആദായനികുതി റിട്ടേണ് സമര്പ്പിക്കാന് പാന് കാര്ഡ് ആധാറുമായി ബന്ധിപ്പിക്കുന്നത് നിര്ബന്ധമാണെന്ന് സുപ്രീംകോടതി. ആദായനികുതി നിയമത്തിലെ 139 എഎ വകുപ്പിലുള്ള ചട്ടങ്ങള് പാലിക്കാന് തയ്യാറാകണമെന്നും കോടതി വ്യക്തമാക്കി. ജസ്റ്റിസ് എ കെ സിക്രി, ജസ്റ്റിസ് എസ് അബ്ദുള് നസീര് എന്നിവരടങ്ങിയ ബഞ്ചിന്റേതാണ് വിധി.
ദില്ലി ഹൈക്കോടതി ഉത്തരവിനെതിരെ കേന്ദ്രസര്ക്കാര് നല്കിയ ഹര്ജിയിലാണ് കോടതി വിധി.2018 ഫെബ്രുവരിയില് ശ്രേയ സെന് എന്നിവരടക്കമുള്ള ഒരു സംഘം ഹര്ജിക്കാര്ക്ക് ആധാര് കാര്ഡും പാന് കാര്ഡും തമ്മില് ബന്ധിപ്പിക്കാതെയും ആദായനികുതി റിട്ടേണ് നല്കാന് ദില്ലി ഹൈക്കോടതി അനുമതി നല്കിയിരുന്നു. റിട്ടേണ് ഫയല് ചെയ്യാന് ആധാര് കാര്ഡുമായി പാന് ബന്ധിപ്പിക്കണമെന്ന് നിര്ബന്ധിക്കരുതെന്നും ദില്ലി ഹൈക്കോടതി ആദായനികുതി വകുപ്പിന് അന്ന് നിര്ദേശം നല്കിയിരുന്നു.ആധാറുമായി ബന്ധപ്പെട്ട് സുപ്രീംകോടതിയില് കേസ് നിലനില്ക്കുന്നുവെന്ന് ചൂണ്ടിക്കാട്ടിയായിരുന്നു പഴയ ഉത്തരവെന്നും, ആധാറുമായി ബന്ധപ്പെട്ട ഭരണഘടനാ ബഞ്ചിന്റെ ഉത്തരവില് ആദായനികുതി നിയമത്തിലെ 139 എഎ വകുപ്പിലുള്ള ചട്ടങ്ങള് ശരി വച്ചിട്ടുണ്ടെന്നും സുപ്രീംകോടതി ചൂണ്ടിക്കാട്ടി. അതിനാല് സുപ്രീംകോടതി ഉത്തരവ് തന്നെയാണ് നിലനില്ക്കുക.അതിനാല് ആധാറും പാന് കാര്ഡും തമ്മില് ബന്ധിപ്പിക്കുന്നത് നിര്ബന്ധമാണെന്നും സുപ്രീംകോടതി വ്യക്തമാക്കി.
2019-20 വര്ഷത്തില് ആദായനികുതി റിട്ടേണ് സുപ്രീംകോടതി ഉത്തരവ് പ്രകാരം തന്നെ സമര്പ്പിക്കണം. അതായത് ആധാര് കാര്ഡും പാന് കാര്ഡും തമ്മില് ബന്ധിപ്പിക്കണം. സുപ്രീംകോടതി വ്യക്തമാക്കി.2018 സെപ്തംബര് 26-നാണ് ആധാറിന് സുപ്രീംകോടതി അംഗീകാരം നല്കിയ നിര്ണായകവിധി വന്നത്. ഭേദഗതികളോടെയാണ് ആധാര് നിയമത്തിന് സുപ്രീംകോടതി അംഗീകാരം നല്കിയത്. ബാങ്ക് അക്കൗണ്ടിനും മൊബൈല് കണക്ഷനും പ്രവേശന പരീക്ഷകള്ക്കും സ്കൂള് പ്രവേശനത്തിനും ആധാര് നിര്ബന്ധമല്ല. ആദായ നികുതിക്കും പാന്കാര്ഡിനും സര്ക്കാര് ആനുകൂല്യങ്ങള്ക്കും നിര്ബന്ധമെന്നും കോടതി വ്യക്തമാക്കി. സുപ്രീംകോടതി ഭരണഘടനാബെഞ്ചില് ഭൂരിപക്ഷം ആധാറിനനുകൂലമായിരുന്നു.ആധാറുമായി ബന്ധപ്പെട്ട സുപ്രധാന ചോദ്യങ്ങള്ക്

ആധാര് ഇല്ലാത്ത കാരണത്താല് രാജ്യത്തിന്റെ വിവിധ ഭാഗങ്ങളിലും ജനങ്ങള്ക്ക് മൊബൈല് സിം നിഷേധിക്കുന്നതായി റിപ്പോര്ട്ടുകളുണ്ടായിരുന്നു.ആധാര് ഇല്ലാതെ സിം കാര്ഡ് നല്കില്ലെന്ന ഡീലര്മാരുടെ തീരുമാനം സാധാരണക്കാരെ മാത്രമല്ല രാജ്യത്തെത്തുന്ന വിനോദ സഞ്ചാരികളെയും വിദേശികളെയും ബാധിച്ചിട്ടുണ്ട്.ഇതുകൊണ്ട് തന്നെയാണ് സര്ക്കാര് ഇക്കാര്യം ഗൗരവമായി കാണുന്നതും ടെലികോം സെക്രട്ടറി വ്യക്തമാക്കി.അന്തിമ വിധി വരുന്നത് വരെ സിം കാര്ഡിന് ആധാര് നിര്ബന്ധമല്ലെന്ന് സുപ്രീംകോടതിയും നിലപാടടെടുത്തിരുന്നു.
