बीते मंगलवार को अपना नया पासपोर्ट बनाने के लिए राहुल गांधी ने दिल्ली के राउज एवेन्यू कोर्ट का दरवाजा खटखटाया था। दरअसल नया पासपोर्ट बनाने के लिए लिए राहुल गांधी को अदालत से NOC की जरूरत थी। इस मामले में आज कोर्ट ने राहुल गांधी की याचिका मंजूर करते हुए उन्हें 3 साल की NOC दे दी। अब राहुल गांधी अपना नया पासपोर्ट बनवा सकेंगे और विदेश यात्रा कर सकेंगे। इससे पहले दिल्ली के राउज एवेन्यू कोर्ट ने राहुल गांधी पासपोर्ट मामले पर फैसला सुरक्षित रख लिया था। इसके बाद कोर्ट ने दोपहर एक बजे आदेश पारित किया।

बीती 14 और 15 मई को सुप्रीम कोर्ट के दो न्यायाधीश सेवानिवृत्त हो चुके हैं। 14 मई को जस्टिस दिनेश माहेश्वरी और अगले दिन ही 15 मई को जस्टिस एमआर शाह रिटायर हो चुके हैं। इनके रिटायर होने के बाद सुप्रीम कोर्ट में जजों की संख्या 34 से घटकर 32 रह गई थी। CJI डी वाई चंद्रचूड़ की अध्यक्षता वाले सुप्रीम कोर्ट के कॉलेजियम ने 2 नए जजों की नियुक्ति के लिए केंद्र सरकार के पास दो नामों की सिफारिश की थी। इनमें आंध्र प्रदेश हाई कोर्ट के चीफ जस्टिस प्रशांत कुमार मिश्रा और सीनियर एडवोकेट केवी विश्वनाथन का नाम शामिल था।

बीते मंगलवार को सुप्रीम कोर्ट ने अपने EWS कोटा बरकरार रखने के फैसले के खिलाफ दायर सभी पुनर्विचार याचिकाएं यानी Review Petitions को खारिज कर दिया। यहां EWS का मतलब है Economically Weaker Section यानी आर्थिक रूप से कमजोर वर्ग और पुनर्विचार याचिका या Review Petition का मतलब है अपने फैसले पर दोबारा विचार करना। सुप्रीम कोर्ट ने मंगलवार को अपने फैसले के याचिकाओं को ख़ारिज करते हुए साफ़ साफ़ कह दिया कि EWS कोटे पर दिए गए फैसले पर अब दोबारा विचार नहीं होगा। बता दें पिछले साल 7 नवंबर को सुप्रीम कोर्ट ने EWS आरक्षण को संवैधानिक माना था और इसके खिलाफ दायर पुनर्विचार याचिकाओं पर बीती 9 मई को 5 जजों की बेंच ने विचार किया था। 7 नवंबर 2022 को दिए गए अपने ऐतिहासिक फैसले में 5 जजों की संविधान पीठ ने 3:2 (3 Ratio 2) के बहुमत से संविधान के 103वें संशोधन को सही करार दिया था। अपना फैसला सुनाते वक्त सुप्रीम कोर्ट ने माना था कि इस तरह का आरक्षण संवैधानिक है और यह किसी भी दूसरे वर्ग के अधिकार का हनन नहीं करता है।

दिल्ली सरकार बनाम उपराज्यपाल के बीच टकराव का एक मामला सुप्रीम कोर्ट में लंबित था। दिल्ली में अधिकारियों की पोस्टिंग और उनके ट्रांसफर के अधिकार की मांग वाली दिल्ली सरकार की याचिका पर कोर्ट ने गुरुवार को दिल्ली सरकार के हक में फैसला सुना दिया। अपने फ़ासिले के साथ सुप्रीम कोर्ट ने दिल्ली की केजरीवाल सरकार की ताकत बढ़ा दी है। सुप्रीम कोर्ट ने अपने फैसले में साफ कहा है कि दिल्ली में अब अफसरों की ट्रांसफर और पोस्टिंग पर दिल्ली सरकार का अधिकार होगा, यानी उपराज्यपाल नहीं मुख्यमंत्री ही दिल्ली के असली बॉस होंगे।

देश में शादी शुदा जोड़ों के तलाक को लेकर सुप्रीम कोर्ट की संविधान पीठ ने एक ऐतिहासिक फैसला लिया है। अब सुप्रीम कोर्ट को जब लगेगा कि कोई शादीशुदा जोड़ा अपनी शादी को आगे और नहीं निभा सकता या उनके बीच जो समस्या है वो खत्म नहीं हो सकती तो उस समय सुप्रीम कोर्ट उस कपल को तलाक के आदेश दे सकता है। कोर्ट ने कहा कि जीवनसाथियों के बीच दरार नहीं भर पाने के आधार पर वह किसी भी शादी को खत्म कर सकता है। SC ने साफ कहा कि पार्टियों को फैमिली कोर्ट भेजने की जरूरत नहीं है, जहां उन्हें 6 से 18 महीने तक का इंतजार करना पड़ सकता है। जस्टिस एस के कौल की अध्यक्षता वाली पांच जजों की पीठ ने साफ कहा कि SC को संविधान के अनुच्छेद 142 के तहत इसका अधिकार है। यह आर्टिकल शीर्ष अदालत के सामने लंबित किसी भी मामले में ‘संपूर्ण न्याय’ के लिए आदेश से संबंधित है। यह फैसला 2014 में दायर शिल्पा शैलेश बनाम वरुण श्रीनिवासन केस में आया है, जिन्होंने भारतीय संविधान के आर्टिकल 142 के तहत तलाक मांगा था।

कर्नाटक में सभी राजनीतिक दल चुनाव प्रचार में जुटे हुए हैं। जनता को लुभाने के लिए बड़े बड़े वादे किए जा रहे हैं। बीते सोमवार को BJP ने और आज कांग्रेस ने कर्नाटक में अपना घोषणापत्र यानी मैनिफेस्टो जारी किया। हमारा फोकस बीजेपी के मेनिफेस्टो में लिखे हुए यूनिफॉर्म सिविल कोड यानी समान नागरिक संहिता पर रहेगा। बता दें कि जनसंघ के ज़माने से ही यूनिफार्म सिविल कोड चुनावी मुद्दा रहा है। कर्नाटक में बीजेपी ने अपने घोषणा पत्र में यूनिफार्म सिविल कोड को प्रमुखता से रखा है। गुजरात और हिमाचल प्रदेश के बाद कर्नाटक में भी बीजेपी ने UCC यानी Uniform Civil Code लागू करने का वादा किया है। माना जा रहा है कि 2024 के चुनाव से पहले भाजपा का अगला टारगेट UCC ही हो सकता है। 2014 और 2019 के लोकसभा चुनाव के संकल्प पत्र में भी भाजपा ने इसे शामिल किया था।

बीते मंगलवार को बिलकिस बानो मामले में 11 दोषियों की रिहाई के खिलाफ याचिका पर सुप्रीम कोर्ट ने सुनवाई करते हुए गुजरात सरकार को खूब फटकार लगाई। इस मामले की सुनवाई जस्टिस के.एम. जोसेफ और जस्टिस बी.वी. नागरत्ना की पीठ ने की। बिलकिस बानो ने गुजरात सरकार पर दोषियों को समय से पहले रिहा करने का आरोप लगाया है। सुनवाई के दौरान अदालत ने सरकार से दोषियों की रिहाई का कारण पूछा। साथ ही केंद्र और गुजरात सरकार से समय से पहले रिहाई देने से जुड़ी फाइलें पेश करने को कहा है। फटकार के बाद बिलकिस बानो केस के दोषियों की रिहाई के खिलाफ दाखिल याचिकाओं पर अब 2 मई को दोपहर बाद दो बजे अंतिम यानी निर्णायक सुनवाई होगी।

बीते साल ही रक्षा मंत्रालय की ओर से सेनाओं में भर्ती के लिए अग्निपथ स्कीम लॉन्च की थी। इस स्कीम के जरिए निचले स्तर पर सेनाओं में भर्ती की जाएगी। इस योजना के तहत 4 साल का कार्यकाल होगा और एग्जिट के बाद अर्धसैनिक बलों समेत तमाम विभागों और फोर्सेज में नौकरी के लिए आरक्षण दिया जाएगा। जब यह स्कीम लांच की गई तो देशभर में इसका विरोध हुआ और कई जगहों पर तो आगजनी और तोड़फोड़ भी हुई।
