കേന്ദ്രീയവിദ്യാലയങ്ങളിലെ ഈശ്വര പ്രാർഥന ഹിന്ദുമതവുമായി ബന്ധപ്പെട്ടതാണെന്നും അതിനാൽ അത് നിർത്തലാക്കണമെന്നും ആവശ്യപ്പെടുന്ന ഹർജി സുപ്രീംകോടതിയുടെ ഭരണഘടനാബെഞ്ചിലേക്ക്.
സർക്കാർ നടത്തുന്ന വിദ്യാഭ്യാസസ്ഥാപനങ്ങൾ ഏതെങ്കിലും ഒരു മതത്തിന് പ്രചാരം കൊടുക്കുന്നത് ശരിയല്ലെന്ന് ചൂണ്ടിക്കാട്ടി മധ്യപ്രദേശിലെ അഡ്വ. വിനായക് ഷായാണ് ഹർജി നൽകിയത്. വിഷയം ഭരണഘടനാബെഞ്ചിന് വിടുന്നതിനായി ജസ്റ്റിസുമാരായ ആർ.എഫ്. നരിമാൻ, വിനീത് സരൺ എന്നിവരുടെ ബെഞ്ച് ചീഫ് ജസ്റ്റിസിന്റെ പരിഗണനയ്ക്കയച്ചു.രാജ്യത്തെ 1,125 കേന്ദ്രീയവിദ്യാലയങ്ങളിൽ പഠിക്കുന്ന വിവിധ മതവിശ്വാസികളായ കുട്ടികളെല്ലാം ‘അസതോമാ സദ്ഗമയാ...’ എന്നു തുടങ്ങുന്ന പ്രാർഥനാഗാനം ആലപിക്കേണ്ടിവരുന്നതായി ഹർജിയിൽ ചൂണ്ടിക്കാട്ടി. സർക്കാർ പണം മുടക്കുന്ന സ്കൂളുകളിലോ മറ്റു വിദ്യാഭ്യാസസ്ഥാപനങ്ങളിലോ ഏതെങ്കിലുമൊരു മതത്തിനു പ്രചാരം നൽകുന്നത് ശരിയല്ല. ഒരു തരത്തിലുള്ള പ്രാർഥനകളും ആവശ്യമില്ല. വിദ്യാർഥികളിൽ ശാസ്ത്ര പഠനാഭിരുചി വളർത്തുന്നതിന് പ്രാർഥനകൾ തടസ്സം നിൽക്കുന്നു. പ്രതിബന്ധങ്ങൾ തരണം ചെയ്യാൻ പ്രായോഗികമാർഗങ്ങൾ തേടുന്നതിനുപകരം ദൈവത്തിൽ അഭയംതേടാനാകും വിദ്യാർഥികൾ ശ്രമിക്കുകയെന്നും ഹർജിയിൽ പറയുന്നു.
സർക്കാർ ഫണ്ട് ഉപയോഗിക്കുന്ന വിദ്യാഭ്യാസസ്ഥാപനങ്ങളിൽ മതപരമായ നിർദേശങ്ങൾ പാടില്ലെന്ന് ഭരണഘടനയുടെ 28(1) വകുപ്പ് വ്യക്തമാക്കുന്നു.
