ഭരണഘടനയുടെ അടിസ്ഥാന തത്വങ്ങളിൽ പെടുന്ന ധാർമികത സ്ത്രീകൾക്കും ലഭിക്കണമെന്നും പ്രവേശനം അനുവദിച്ചുകൊണ്ടുള്ള വിധി തുടരണമെന്നും ആവശ്യപ്പെട്ട് ഹാപ്പി ടു ബ്ലീഡ് സംഘടനയ്ക്ക് വേണ്ടി ഹാജരായ അഭിഭാഷക ഇന്ദിര ജയ്സിങിനോടായിരുന്നു കോടതിയുടെ ഓർമ്മപ്പെടുത്തൽ. വിധി തുടരണമെന്നാണ് ഞങ്ങളുടെ ആവശ്യം. അത് ശരിയോ തെറ്റോ എന്നത് എന്റെ വിഷയമല്ല. വിധി എതിരാണെങ്കിൽ ഞങ്ങൾ കലാപമുണ്ടാകില്ല. യുവതികൾ യുദ്ധത്തിനു പുറപ്പെടില്ലെന്നും ഇന്ദിര ജയ്സിങ് കോടതിയിൽ പറഞ്ഞത്.
എന്നാൽ ഡൽഹി ഭരിച്ച ഏക വനിതാ ഭരണാധികാരിയായ റസിയ സുൽത്താനയുടെ ശവകുടീരമടക്കമുള്ളനാടാണ് ഇതെന്നായിരുന്നു ഇതിന് മറുപടിയായി ജസ്റ്റിസ് നരിമാന്റെ പ്രതികരണം. ചരിത്രം പഠിച്ചാൽ മറ്റൊന്നാണ് വസ്തുതയെന്ന് പറഞ്ഞ അദ്ദേഹം, ഒട്ടേറെ വനിത യോദ്ധാക്കൾ നമ്മുക്ക് ഉണ്ടായിരുന്നെന്നും ഇന്ദിര ജയ്സിങ്ങിനെ ഓർമിപ്പിച്ചു.പിറകെ എത്രയും പെട്ടെന്ന് അടുത്ത പോയിന്റിലേക്ക് വരണമെന്ന് ചീഫ് ജസ്റ്റിസും നിർദേശിക്കുകയായിരുന്നു.
കോടതിക്കുമുന്നിലുള്ള ശബരിമല കേസിന്റെ അടിസ്ഥാന തത്വം ലിംഗ വിവേചനമാണെന്നായിരുന്നു ഇന്ദിര ജയ്സിങിന്റെ പ്രധാന വാദം.
തൊട്ടുകൂടായ്മയെ പിന്തുണയ്ക്കുകയാണ് ചിലർ. ആർത്തവമുള്ള യുവതികൾ അശുദ്ധരാണെന്നും ശുചിയില്ലാത്തവരാണെന്നുമാണ് കണക്കാക്കപ്പെടുന്നത്. ക്ഷേത്രത്തിലെത്തി ദർശനം നടത്തണമെന്നാണ് എന്റെ കക്ഷിയുടെ ആവശ്യം. രേഷ്മ, ഷാനില എന്നിവർക്ക് ശബരിമലയിൽ പോകാൻ എല്ലാ സുരക്ഷയും തരണം. ഇതിനായി കോടതി ഉത്തരവ് ഇറക്കണം. ഞാൻ ക്ഷേത്രത്തിൽ പോകണം എന്ന് വച്ചാൽ എന്നെ നിയമപരമായി ആർക്കും തടയാൻ കഴിയില്ല. ഞാൻ ഒരു വ്യക്തി ആണെങ്കിൽ എനിക്ക് ക്ഷേത്രത്തിൽ പോകാൻ എല്ലാ അധികാരവും ഭരണഘടന നൽകുന്നുണ്ട്. എന്റെ വീട് ആണ് എന്റെ ക്ഷേത്രം. എല്ലാ ക്ഷേത്രങ്ങളിലും എനിക്ക് കയറാം. അയ്യപ്പ സ്വാമി എന്നെ തടയില്ല. ശുദ്ധിക്രിയ നടത്തിയത് ഭരണഘടനയ്ക്ക് ഉണ്ടാക്കിയ മുറിവാണെന്നും അവർ പറയുന്നു.

ഭരണഘടനയുടെ അടിസ്ഥാന തത്വങ്ങളിൽ പെടുന്ന ധാർമികത സ്ത്രീകൾക്കും ലഭിക്കണമെന്നും പ്രവേശനം അനുവദിച്ചുകൊണ്ടുള്ള വിധി തുടരണമെന്നും ആവശ്യപ്പെട്ട് ഹാപ്പി ടു ബ്ലീഡ് സംഘടനയ്ക്ക് വേണ്ടി ഹാജരായ അഭിഭാഷക ഇന്ദിര ജയ്സിങിനോടായിരുന്നു കോടതിയുടെ ഓർമ്മപ്പെടുത്തൽ. വിധി തുടരണമെന്നാണ് ഞങ്ങളുടെ ആവശ്യം. അത് ശരിയോ തെറ്റോ എന്നത് എന്റെ വിഷയമല്ല. വിധി എതിരാണെങ്കിൽ ഞങ്ങൾ കലാപമുണ്ടാകില്ല. യുവതികൾ യുദ്ധത്തിനു പുറപ്പെടില്ലെന്നും ഇന്ദിര ജയ്സിങ് കോടതിയിൽ പറഞ്ഞത്.
എന്നാൽ ഡൽഹി ഭരിച്ച ഏക വനിതാ ഭരണാധികാരിയായ റസിയ സുൽത്താനയുടെ ശവകുടീരമടക്കമുള്ളനാടാണ് ഇതെന്നായിരുന്നു ഇതിന് മറുപടിയായി ജസ്റ്റിസ് നരിമാന്റെ പ്രതികരണം. ചരിത്രം പഠിച്ചാൽ മറ്റൊന്നാണ് വസ്തുതയെന്ന് പറഞ്ഞ അദ്ദേഹം, ഒട്ടേറെ വനിത യോദ്ധാക്കൾ നമ്മുക്ക് ഉണ്ടായിരുന്നെന്നും ഇന്ദിര ജയ്സിങ്ങിനെ ഓർമിപ്പിച്ചു.പിറകെ എത്രയും പെട്ടെന്ന് അടുത്ത പോയിന്റിലേക്ക് വരണമെന്ന് ചീഫ് ജസ്റ്റിസും നിർദേശിക്കുകയായിരുന്നു.
കോടതിക്കുമുന്നിലുള്ള ശബരിമല കേസിന്റെ അടിസ്ഥാന തത്വം ലിംഗ വിവേചനമാണെന്നായിരുന്നു ഇന്ദിര ജയ്സിങിന്റെ പ്രധാന വാദം.
തൊട്ടുകൂടായ്മയെ പിന്തുണയ്ക്കുകയാണ് ചിലർ. ആർത്തവമുള്ള യുവതികൾ അശുദ്ധരാണെന്നും ശുചിയില്ലാത്തവരാണെന്നുമാണ് കണക്കാക്കപ്പെടുന്നത്. ക്ഷേത്രത്തിലെത്തി ദർശനം നടത്തണമെന്നാണ് എന്റെ കക്ഷിയുടെ ആവശ്യം. രേഷ്മ, ഷാനില എന്നിവർക്ക് ശബരിമലയിൽ പോകാൻ എല്ലാ സുരക്ഷയും തരണം. ഇതിനായി കോടതി ഉത്തരവ് ഇറക്കണം. ഞാൻ ക്ഷേത്രത്തിൽ പോകണം എന്ന് വച്ചാൽ എന്നെ നിയമപരമായി ആർക്കും തടയാൻ കഴിയില്ല. ഞാൻ ഒരു വ്യക്തി ആണെങ്കിൽ എനിക്ക് ക്ഷേത്രത്തിൽ പോകാൻ എല്ലാ അധികാരവും ഭരണഘടന നൽകുന്നുണ്ട്. എന്റെ വീട് ആണ് എന്റെ ക്ഷേത്രം. എല്ലാ ക്ഷേത്രങ്ങളിലും എനിക്ക് കയറാം. അയ്യപ്പ സ്വാമി എന്നെ തടയില്ല. ശുദ്ധിക്രിയ നടത്തിയത് ഭരണഘടനയ്ക്ക് ഉണ്ടാക്കിയ മുറിവാണെന്നും അവർ പറയുന്നു.
