ജീവിക്കാനും വ്യക്തി സ്വാതന്ത്ര്യത്തിനുമുള്ള അവകാശം ഉറപ്പാക്കുന്ന 21-ാം ഭരണഘടനാ അനുച്ഛേദവുമായി പൊരുത്തപ്പെടുന്നതല്ല 497-ാം വകുപ്പ്. വിവാഹമോചനത്തിന് വിവാഹേതര ലൈംഗികബന്ധം കാരണമാകാം. എന്നാല്‍ അതൊരു ക്രിമിനല്‍ കുറ്റമല്ല. വിവാഹേതര ലൈംഗിക ബന്ധത്തിന്റെ പേരില്‍ പങ്കാളി ആത്മഹത്യ ചെയ്താല്‍ തെളിവുണ്ടെങ്കില്‍ ആത്മഹത്യാ പ്രേരണാക്കുറ്റത്തിന് കേസെടുക്കാമെന്നും കോടതി വ്യക്തമാക്കി .സ്ത്രീയുടെ അധികാരി ഭർത്താവല്ല. സ്ത്രീക്കും പുരുഷനും തുല്യ അധികാരമാണ്. വിവേചനം ഭരണഘടനാവിരുദ്ധമാണ്. വിവാഹേതരബന്ധത്തിൽ പുരുഷനെ മാത്രം കുറ്റക്കാരനാക്കുന്ന എെപിസി സെക്ഷൻ 497 സ്ത്രീകളുടെ അഭിമാനത്തിന് കളങ്കമേൽപ്പിക്കുന്നു. തുല്യതയ്ക്കുള്ള അവകാശം ലംഘിക്കുന്നു. സമൂഹം പറയുന്നതുപോലെ പ്രവർത്തിക്കാൻ സ്ത്രീ ബാധ്യസ്ഥയല്ലെന്നും സെക്ഷൻ 497 ഭരണഘടനാ വിരുദ്ധമാണെന്നും നീക്കം ചെയ്യേണ്ടതാണെന്നും കോടതി വിലയിരുത്തി .വിവാഹേതരബന്ധം ക്രിമിനല്‍ക്കുറ്റമാക്കുന്ന 158 വര്‍ഷം പഴക്കമുള്ള 497-ാം വകുപ്പ് റദ്ദാക്കണമെന്നാവശ്യപ്പെട്ട് പ്രവാസി മലയാളി ജോസഫ് ഷൈനാണ് ഹര്‍ജി നല്‍കിയത്.

അഡല്‍ട്ടറി അഥവാ പരസ്ത്രീബന്ധം ശിക്ഷാര്‍ഹമാക്കുന്ന നിയമം പുന:പരിശോധിക്കണമെന്ന് സുപ്രീംകോടതി കേന്ദ്ര സര്‍ക്കാറിനോട് ആവശ്യപ്പെട്ടു.ഇന്ത്യന്‍ ശിക്ഷാ നിയമത്തിലെ 497 ാം വകുപ്പ് കാലഹരണപ്പെട്ടതും പൗരാണികവുമാണെന്ന് സുപ്രീംകോടതിയുടെ നിരീക്ഷണം. ഐപിസി 497ാം വകുപ്പ് ലിംഗ സമത്വത്തിന് എതിരാണെന്ന് ചൂണ്ടിക്കാട്ടി നല്‍കിയ പൊതുതാത്പര്യ ഹര്‍ജിയിലാണ് സുപ്രീംകോടതി കേന്ദ്രസര്‍ക്കാരിന്റെ വിശദീകരണം തേടിയത്.ഐപിസി(ഇന്ത്യന്‍ ശിക്ഷാ നിയമം) 497ാം വകുപ്പ് പ്രകാരം വിവാഹേതര ബന്ധത്തില്‍ ഏര്‍പ്പെടുന്ന പുരുഷന് എതിരെ മാത്രമേ കേസ് എടുക്കാനും ശിക്ഷിക്കാനും വ്യവസ്ഥയുള്ളു. സ്ത്രീക്ക് എതിരെ കേസ് രജിസ്റ്റര്‍ ചെയ്യാന്‍ വ്യവസ്ഥയില്ല. അതിനാല്‍ വിവാഹത്തിന് ശേഷം മറ്റൊരു സ്ത്രീയുമായി ബന്ധമുള്ള പുരുഷന് ശിക്ഷിക്കപ്പെടുമ്പോള്‍ പരപുരുഷനുമായി ബന്ധമുള്ള സ്ത്രീയെ നിയമം സംരക്ഷിക്കുകയാണ് ചെയ്യുന്നത്. അത്തരം കേസുകളിലും സ്ത്രീയുമായി ബന്ധമുള്ള പുരുഷന് മാത്രമാണ് ശിക്ഷിക്കപ്പെടുന്നത്. ഡിവോഴ്‌സ് കേസുകളില്‍ മാത്രമാണ് പരപുരുഷ ബന്ധവും പരസ്ത്രീ ബന്ധവും ഒരുപോലെ പരിഗണിക്കപ്പെടുന്നത്.

Supreme Court strikes down Maharashtra law granting reservation to Maratha community
The Supreme Court on Wednesday struck down the Maharashtra law granting quota to Marathas in admissions and government jobs, terming the statute as “unconstitutional". It also refused to refer the 1992 Mandal judgement, setting a 50 per cent cap on reservation, to a larger bench for reconsideration.
