तीन बार तलाक के मामले में मुस्लिम पर्सनल लॉ बोर्ड ने सुप्रीम कोर्ट में हलफनामा दाखिल कर दिया है और अपने जवाब में कहा है कि तीन तलाक के मामले पर न्यायालय निर्णय नहीं दे सकता है, क्योंकि तीन तलाक का फैसला कुरान से लिया गया है। इस मामले में पिछली सुनवाई में सुप्रीम कोर्ट ने केंद्र सरकार और मुस्लिम पर्सनल लॉ बोर्ड से जवाब मांगा था। सुप्रीम कोर्ट को दिए जवाब में बोर्ड ने कहा कि पर्सनल लॉ को चुनौती नहीं दी जा सकती, ऐसा करना संविधान के पार्ट-3 का उल्लंघन है। यह इस्लाम धर्म से संबंधित सांस्कृतिक मुद्दा है। कुरान में तलाक को अवांछनीय कहा गया है, मगर आवश्यकता पड़ने पर यह तलाक दिया जा सकता है। तलाक समानता का अधिकार है पुरुष और महिला दोनों ही इस अधिकार का इस्तेमाल कर सकते हैं। पर्सनल लॉ बोर्ड का कहना है कि तीन तलाक का नियम सही है। इसे गलत नहीं ठहराया जा सकता है। पर्सनल लॉ बोर्ड ने कहा कि न्यायालय तलाक की वैधता को गलत नहीं मान सकता है। आपको बता दें कि पिछली सुनवाई में सुप्रीम कोर्ट ने सवाल किया था कि अगर इस्लाम के मुताबिक कोई चार शादियां कर सकता है, तो फिर दूसरी शादी के लिए तीन तलाक देने की क्या ज़रुरत है।
