    കേന്ദ്ര സര്‍ക്കാരിന് തിരിച്ചടി നല്‍കി ആലോക് വര്‍മയെ സിബിഐ തലപ്പത്ത് സുപ്രീംകോടതി പുനഃസ്ഥാപിച്ചു.



    സുപ്രീംകോടതി ആലോക് വര്‍മയെ നീക്കിയ നടപടി റദ്ദാക്കി. ആലോക് വര്‍മയ്‌ക്കെതിരായ കേസിലെ റിപ്പോര്‍ട്ട് വരുന്നത് വരെ നയപരമായ തീരുമാനങ്ങളൊന്നും അദ്ദേഹം എടുക്കരുതെന്നും കോടതി ഉത്തരവിട്ടിട്ടുണ്ട്‌ .ഉന്നതാധികാര സമിതി ഒരാഴ്ചയ്ക്കകം യോഗം ചേര്‍ന്ന് അദ്ദേഹത്തിനെതിരായ ആരോപണങ്ങള്‍ പരിശോധിക്കണമെന്നാണ് കോടതി നിര്‍ദേശിച്ചിരിക്കുന്നത്‌.തന്നെ നീക്കിയതിനെതിരേ സി.ബി.ഐ. ഡയറക്ടര്‍ ആലോക് വര്‍മ നല്‍കിയ ഹര്‍ജിയിലാണ് ചീഫ് ജസ്റ്റിസ് രഞ്ജന്‍ ഗൊഗോയ് അധ്യക്ഷനായ ബെഞ്ചിന്റെ വിധി.ഇന്ന് ചീഫ് ജസ്റ്റിസ് ഗൊഗോയ് അവധിയിലായിരുന്നതിനാല്‍ ബെഞ്ചിലെ അംഗമായ ജസ്റ്റിസ് എസ്.കെ.കൗളാണ് വിധി പ്രസ്താവം നടത്തിയത്. കെ.എം.ജോസഫാണ് ബെഞ്ചിലുണ്ടായിരുന്ന മറ്റൊരു ജഡ്ജി.

    സിബിഐ ഡയറക്ടറെ നിയമിക്കുന്നത് പ്രധാനമന്ത്രിയും ചീഫ് ജസ്റ്റിസും പ്രതിപക്ഷ നേതാവും ഉള്‍പ്പെട്ട സെലക്ഷന്‍ കമ്മറ്റിയാണ്.

    സിബിഐ ഡയറക്ടറെ മാറ്റാനും ഈ സെലക്ഷന്‍ കമ്മിറ്റിക്കേ കഴിയൂ എന്ന ആലോക് വര്‍മയുടെ വാദം സുപ്രീംകോടതി ശരിവെക്കുകയായിരുന്നു. അതേ സമയം അലോക് വര്‍മക്കെതിരെയുള്ള പരാതി സുപ്രീംകോടതി പരിഗണിച്ചിട്ടില്ല.ഒക്ടോബര്‍ 23 ന് ആലോക് വര്‍മയെ മാറ്റിക്കൊണ്ടുള്ള കേന്ദ്ര സര്‍ക്കാരിന്റെ വിജ്ഞാപനം റദ്ദാക്കുകയാണ് ഇപ്പോള്‍ കോടതി ചെയ്തിരിക്കുന്നത്. അതേ സമയം ആലോക് വര്‍മ തിരികെ ഈ സ്ഥാനത്തേക്ക് വന്നാലും സുപ്രധാനപരമായ തീരുമാനങ്ങള്‍ എടുക്കരുതെന്ന കോടതിയുടെ ഉപാധി സര്‍ക്കാരിന് താത്ക്കാലിക ആശ്വാസം നല്‍കുന്നുണ്ട്.


    കേന്ദ്രസര്‍ക്കാരിന് ഏറെ രാഷ്ട്രീയപ്രാധാന്യമുള്ള കേസായിരുന്നു ഇത്.


    പരസ്പരം അഴിമതിയാരോപണമുന്നയിച്ച വര്‍മയെയും സ്‌പെഷ്യല്‍ ഡയറക്ടര്‍ രാകേഷ് അസ്താനയെയും മാറ്റിനിര്‍ത്തി എം. നാഗേശ്വര റാവുവിന് സി.ബി.ഐ. ഡയറക്ടറുടെ ചുമതല നല്‍കുകയായിരുന്നു.ഇതിനെതിരേ വര്‍മയും അസ്താനയും സന്നദ്ധസംഘടനയായ കോമണ്‍ കോസും സുപ്രീംകോടതിയിലെത്തി. അസ്വാഭാവിക സാഹചര്യങ്ങള്‍ ഉണ്ടായതുകൊണ്ടാണ് സി.ബി.ഐ. ഡയറക്ടര്‍ക്കെതിരേ അസ്വാഭാവിക നടപടികളും വേണ്ടിവന്നതെന്നാണ് സി.വി.സി.വാദിച്ചത്‌. വര്‍മയും
