ആധാര്‍ ഇല്ലാതെ സിം കാര്ഡ് നല്‍കില്ലെന്ന ഡീലര്‍മാരുടെ തീരുമാനത്തിനെതിരെ കേന്ദ്രം .ആധാര്‍ മൊബൈല്‍ സിം കാര്ഡിന് നിര്‍ബന്ധമാക്കേണ്ടതില്ലെന്ന് സര്ക്കാര് നിര്‍ദ്ദേശം.മറ്റ് തിരിച്ചറിയല്‍ രേഖകളായ ഡ്രൈവിംഗ് ലൈസന്‍സ്,പാസ്‌പോര്‍ട്ട്,വോട്ടേഴ്‌സ് ഐഡി തുടങ്ങിയ തിരിച്ചറിയല്‍ രേഖകളുണ്ടെങ്കില്‍ സിം അനുവദിക്കണമെന്ന് ടെലികോം സെക്രട്ടറി അരുണ സുന്ദരരാജന്‍ അറിയിച്ചു.എല്ലാ മൊബൈല്‍ കമ്പനികള്‍ക്കും കേന്ദ്രം ഇത് സംബന്ധിച്ച് നിര്‍ദ്ദേശം നല്‍കിയിട്ടുണ്ട്.
ആധാര്‍ ഇല്ലാത്ത കാരണത്താല്‍ രാജ്യത്തിന്റെ വിവിധ ഭാഗങ്ങളിലും ജനങ്ങള്‍ക്ക് മൊബൈല്‍ സിം നിഷേധിക്കുന്നതായി റിപ്പോര്‍ട്ടുകളുണ്ടായിരുന്നു.ആധാര്‍ ഇല്ലാതെ സിം കാര്ഡ് നല്‍കില്ലെന്ന ഡീലര്‍മാരുടെ തീരുമാനം സാധാരണക്കാരെ മാത്രമല്ല രാജ്യത്തെത്തുന്ന വിനോദ സഞ്ചാരികളെയും വിദേശികളെയും ബാധിച്ചിട്ടുണ്ട്.ഇതുകൊണ്ട് തന്നെയാണ് സര്ക്കാര് ഇക്കാര്യം ഗൗരവമായി കാണുന്നതും ടെലികോം സെക്രട്ടറി വ്യക്തമാക്കി.അന്തിമ വിധി വരുന്നത് വരെ സിം കാര്ഡിന് ആധാര്‍ നിര്‍ബന്ധമല്ലെന്ന് സുപ്രീംകോടതിയും നിലപാടടെടുത്തിരുന്നു.

വിവിധ സർക്കാർ സേവനങ്ങൾക്ക് ആധാർ നമ്പർ ബന്ധിപ്പിക്കണമെന്ന കേന്ദ്രസർക്കാർ ഉത്തരവിനു സ്റ്റേ ഇല്ല.
ആധാർ ബന്ധിപ്പിക്കുന്നതിനുള്ള സമയപരിധി കേസ് പരിഗണിച്ച സുപ്രീംകോടതി അഞ്ചംഗ ഭരണഘടനാ ബെഞ്ച് 2018 മാർച്ച് 31 വരെ നീട്ടി നൽകി. ബാങ്ക് അക്കൗണ്ട്, സർക്കാർ ആനുകൂല്യങ്ങൾ, പാൻ കാർഡ്, മൊബൈൽ ഫോൺ കണക്‌ഷൻ തുടങ്ങിയവയ്‌ക്കാണ് കേന്ദ്രസർക്കാർ ആധാർ നമ്പർ നിർബന്ധമാക്കി ഉത്തരവിറക്കിയത്.
ആധാർ നമ്പറും പാൻ നമ്പറും ബാങ്ക് അക്കൗണ്ടുമായി ബന്ധിപ്പിക്കുന്നതിനുള്ള സമയപരിധി 2018 മാർച്ച് 31വരെ നീട്ടിയതായി കേന്ദ്ര ധനമന്ത്രാലയം കഴിഞ്ഞ ദിവസം അറിയിച്ചിരുന്നു.

ആധാറുമായി ബന്ധപ്പെട്ട സുപ്രധാന ചോദ്യങ്ങള്‍ക്കാണ് സുപ്രീം കോടതി വിധിയോടെ ഉത്തരമായത്
ആദായനികുതി റിട്ടേണ്‍ സമര്‍പ്പിക്കാന്‍ പാന്‍ കാര്ഡ് ആധാറുമായി ബന്ധിപ്പിക്കുന്നത് നിര്‍ബന്ധമാണെന്ന് സുപ്രീംകോടതി. ആദായനികുതി നിയമത്തിലെ 139 എഎ വകുപ്പിലുള്ള ചട്ടങ്ങള്‍ പാലിക്കാന്‍ തയ്യാറാകണമെന്നും കോടതി വ്യക്തമാക്കി. ജസ്റ്റിസ് എ കെ സിക്രി, ജസ്റ്റിസ് എസ് അബ്ദുള്‍ നസീര്‍ എന്നിവരടങ്ങിയ ബഞ്ചിന്‍റേതാണ് വിധി.
ദില്ലി ഹൈക്കോടതി ഉത്തരവിനെതിരെ കേന്ദ്രസര്‍ക്കാ‍ര്‍ നല്‍കിയ ഹര്‍ജിയിലാണ് കോടതി വിധി.2018 ഫെബ്രുവരിയില്‍ ശ്രേയ സെന്‍ എന്നിവരടക്കമുള്ള ഒരു സംഘം ഹര്‍ജിക്കാര്‍ക്ക് ആധാര്‍ കാര്‍ഡും പാന്‍ കാര്‍ഡും തമ്മില്‍ ബന്ധിപ്പിക്കാതെയും ആദായനികുതി റിട്ടേണ്‍ നല്‍കാന്‍ ദില്ലി ഹൈക്കോടതി അനുമതി നല്‍കിയിരുന്നു. റിട്ടേണ്‍ ഫയല്‍ ചെയ്യാന്‍ ആധാര്‍ കാര്‍ഡുമായി പാന്‍ ബന്ധിപ്പിക്കണമെന്ന് നിര്‍ബന്ധിക്കരുതെന്നും ദില്ലി ഹൈക്കോടതി ആദായനികുതി വകുപ്പിന് അന്ന് നിര്‍ദേശം നല്‍കിയിരുന്നു.ആധാറുമായി ബന്ധപ്പെട്ട് സുപ്രീംകോടതിയില്‍ കേസ് നിലനില്‍ക്കുന്നുവെന്ന് ചൂണ്ടിക്കാട്ടിയായിരുന്നു പഴയ ഉത്തരവെന്നും, ആധാറുമായി ബന്ധപ്പെട്ട ഭരണഘടനാ ബഞ്ചിന്‍റെ ഉത്തരവില്‍ ആദായനികുതി നിയമത്തിലെ 139 എഎ വകുപ്പിലുള്ള ചട്ടങ്ങള്‍ ശരി വച്ചിട്ടുണ്ടെന്നും സുപ്രീംകോടതി ചൂണ്ടിക്കാട്ടി. അതിനാല്‍ സുപ്രീംകോടതി ഉത്തരവ് തന്നെയാണ് നിലനില്‍ക്കുക.അതിനാല്‍ ആധാറും പാന്‍ കാര്‍ഡും തമ്മില്‍ ബന്ധിപ്പിക്കുന്നത് നിര്‍ബന്ധമാണെന്നും സുപ്രീംകോടതി വ്യക്തമാക്കി.
2019-20 വര്‍ഷത്തില്‍ ആദായനികുതി റിട്ടേണ്‍ സുപ്രീംകോടതി ഉത്തരവ് പ്രകാരം തന്നെ സമര്‍പ്പിക്കണം. അതായത് ആധാര്‍ കാര്‍ഡും പാന്‍ കാര്‍ഡും തമ്മില്‍ ബന്ധിപ്പിക്കണം. സുപ്രീംകോടതി വ്യക്തമാക്കി.2018 സെപ്തംബര്‍ 26-നാണ് ആധാറിന് സുപ്രീംകോടതി അംഗീകാരം നല്‍കിയ നിര്‍ണായകവിധി വന്നത്. ഭേദഗതികളോടെയാണ് ആധാര്‍ നിയമത്തിന് സുപ്രീംകോടതി അംഗീകാരം നല്‍കിയത്. ബാങ്ക് അക്കൗണ്ടിനും മൊബൈല്‍ കണക്ഷനും പ്രവേശന പരീക്ഷകള്‍ക്കും സ്കൂള്‍ പ്രവേശനത്തിനും ആധാര്‍ നിര്‍ബന്ധമല്ല. ആദായ നികുതിക്കും പാന്‍കാര്‍ഡിനും സര്ക്കാര് ആനുകൂല്യങ്ങള്‍ക്കും നിര്‍ബന്ധമെന്നും കോടതി വ്യക്തമാക്കി. സുപ്രീംകോടതി ഭരണഘടനാബെഞ്ചില്‍ ഭൂരിപക്ഷം ആധാറിനനുകൂലമായിരുന്നു.ആധാറുമായി ബന്ധപ്പെട്ട സുപ്രധാന ചോദ്യങ്ങള്‍ക്દ્વારા News60 ML | 137 અભિપ્રાયો
