Supreme Court asks Parliament to frame laws to bar those accused of crimes from fighting elections

കേസിൽ പെട്ടതിന്റെ പേരിൽ തിരഞ്ഞെടുപ്പിൽ മൽസരിക്കുന്നതിൽനിന്ന് അയോഗ്യരാക്കണമെന്ന ആവശ്യം പരിഗണിക്കുകയായിരുന്നു കോടതി. ഗുരുതര കേസുള്ളവർ മൽസരിക്കുന്നത് തടയാൻ സർക്കാർ നിയമനിർമാണം നടത്തണം. സ്ഥാനാർഥികൾ കേസുകളുടെ വിവരങ്ങൾ നിർബന്ധമായും വെളിപ്പെടുത്തണമെന്നും കോടതി നിർദേശിച്ചു. ചീഫ് ജസ്റ്റിസ് അധ്യക്ഷനായ ഭരണഘടനാ ബെഞ്ചിന്റേതാണ് നിരീക്ഷണം.ക്രിമിനല്‍ കേസുകളിലെ കുറ്റപത്രത്തിന്റെ അടിസ്ഥാനത്തിൽ തിരഞ്ഞെടുപ്പിൽ മല്‍സരിക്കുന്നതു വിലക്കാന്‍ സുപ്രീംകോടതിക്കാകില്ലെന്ന് ചീഫ് ജസ്റ്റിസ് ദീപക് മിശ്ര വിധിയിൽ പറഞ്ഞു. ക്രിമിനൽ പശ്ചാത്തലമുള്ളവർ രാഷ്ട്രീയത്തിൽ വരുന്നതു തടയാൻ കോടതി മാർഗനിർദേശം പുറപ്പെടുവിച്ചു. കേസിന്റെ വിശദാംശങ്ങൾ തിരഞ്ഞെടുപ്പ് സത്യവാങ്മൂലത്തിൽ നൽകണം.അഞ്ച് സംസ്ഥാനങ്ങളിലേക്കുള്ള നിയമസഭാ തിരഞ്ഞെടുപ്പും ലോക്സഭാ തിരഞ്ഞെടുപ്പും നടക്കാനിരിക്കെയാണ് സുപ്രീം കോടതി വിധി പുറത്തുവരുന്നത്. നിലവിൽ ഒരു കേസിൽ ശിക്ഷിക്കപ്പെട്ടാൽ മാത്രമേ ജനപ്രതിനിധികൾ ആയോഗ്യരാകുകയുള്ളു. കുറ്റക്കാരനാണെന്നു കോടതി കണ്ടെത്തുംവരെ കുറ്റാരോപിതൻ മാത്രമാണെന്ന കാര്യം മറക്കരുതെന്ന് കേന്ദ്രസർക്കാർ സുപ്രീംകോടതിയിൽ നിലപാടെടുത്തു. നിയമനിർമാണം പാർലമെന്റിന്റെ അധികാരമാണെന്നും കേന്ദ്രം വ്യക്തമാക്കിയിരുന്നു.
